This Privacy Policy describes how Mayberry Law, a California law firm located in Culver City, California (“Mayberry Law,” “the Firm,” “we,” “us,” or “our”), collects, uses, and shares information when you visit mayberrylawoffice.com or mayberry.law (together, the “Site”), contact us through the Site, or otherwise interact with us online, including by email, phone, or text message initiated through the Site. By using the Site, you agree to the practices described in this Policy.
This Policy applies to the Site and related online communications. It does not replace or modify the terms of any engagement agreement between the Firm and its clients. Where this Policy conflicts with our professional responsibility obligations, the attorney-client privilege, or the terms of an engagement agreement, those obligations and terms control.
1. Information We Collect
Information you provide to us. When you fill out a contact or case evaluation form, request a consultation, subscribe to updates, use a chat feature, or call or text us, you may provide information such as your name, email address, phone number, mailing address, and any details you choose to share about your legal matter or the reason for your inquiry. As permitted by law, calls with our office may be monitored or recorded for quality assurance and record-keeping purposes, and chat and text message conversations may be retained.
Information collected automatically. When you visit the Site, we and our service providers may automatically collect certain information about your device and how you interact with the Site, such as your IP address, browser and device type, operating system, referring pages or sources, pages viewed, dates and times of access, approximate geographic location, and similar usage data. This information is collected through cookies, pixels, log files, and similar technologies, as described in Section 4.
Information from other sources. We may receive information about you from other sources, such as publicly available records, referral sources, advertising and analytics providers, and service providers that assist us with intake, marketing, or communications. We may combine this information with information you provide to us.
2. How We Use Information
We use the information we collect to:
- Respond to your inquiries, schedule consultations, and evaluate whether we can assist with a potential legal matter.
- Provide, administer, and improve our legal services, the Site, and our communications.
- Communicate with you, including sending appointment reminders, responding to your messages, and — where permitted by law — sending information about our services, legal developments, or other content we believe may interest you.
- Operate, analyze, and improve our marketing and advertising, including measuring the performance of campaigns and understanding how visitors find and use the Site.
- Protect the security and integrity of the Site, prevent fraud and abuse, and diagnose technical issues.
- Comply with applicable legal, regulatory, and professional responsibility obligations.
- Fulfill any other purpose disclosed to you at the time of collection or with your consent.
3. How We Share Information
We do not sell your personal information. We may share information in the following circumstances:
- Service providers. We work with third parties that perform services on our behalf, such as website hosting and content management, analytics, advertising and marketing, email and text message delivery, scheduling, client intake and case management, payment processing, and IT and security services. These providers are permitted to use your information only to perform services for us.
- Professional collaborators. In connection with a legal matter, we may share information with co-counsel, experts, investigators, court reporters, and other professionals assisting in the representation. Information relating to client matters is handled in accordance with our engagement agreements and applicable rules of professional conduct.
- Legal requirements. We may disclose information when we believe in good faith that disclosure is required or permitted by law, such as in response to a subpoena, court order, or other legal process, or to protect the rights, property, or safety of the Firm, our clients, or others.
- Business transfers. If the Firm or substantially all of its assets are involved in a merger, acquisition, reorganization, or similar transaction, information may be transferred as part of that transaction, subject to applicable ethical obligations.
- With your consent. We may share information for any other purpose with your consent or at your direction.
4. Cookies and Tracking Technologies
The Site uses cookies and similar technologies, which may include:
- Essential cookies that are necessary for the Site to function.
- Analytics cookies that help us understand how visitors use the Site so we can improve it.
- Advertising cookies and pixels that may be used to measure the effectiveness of our marketing and to show you relevant information about our services on other platforms.
Some of these technologies are operated by third parties, such as analytics and advertising providers. Those third parties may collect information about your online activities over time and across different websites and online services when you use the Site. The Site may also include links to or features from social media platforms, which may collect information about your interactions with those features.
Most browsers allow you to control cookies through their settings, including blocking or deleting them. Disabling cookies may affect the functionality of some features of the Site. Like most websites, the Site does not currently respond to “Do Not Track” browser signals. You may be able to limit certain third-party tracking through your browser settings or industry-provided opt-out tools.
5. Text Messaging (SMS)
If you provide your phone number and opt in to receive text messages from us, we may send you texts related to your inquiry, consultation, or matter. Message frequency varies, and message and data rates may apply. You can opt out at any time by replying STOP, or reply HELP for assistance. No mobile information, text messaging originator opt-in data, or consent will be shared with or sold to third parties or affiliates for marketing or promotional purposes.
6. No Attorney-Client Relationship Through the Site
Contacting us through the Site, by email, or by text message does not create an attorney-client relationship. An attorney-client relationship with the Firm is formed only through a written engagement agreement signed by you and the Firm. Please do not send confidential or time-sensitive information about your matter through the Site until we have confirmed in writing that we represent you. While we treat all inquiries with discretion, information submitted before an attorney-client relationship is established may not be protected by the attorney-client privilege.
7. Data Retention
We retain information for as long as reasonably necessary to fulfill the purposes described in this Policy, to comply with our legal, regulatory, and professional record-keeping obligations (including client file retention requirements), to resolve disputes, and to enforce our agreements. Retention periods vary depending on the nature of the information and our obligations.
8. Security
We use reasonable administrative, technical, and physical safeguards designed to protect the information we collect. However, no method of transmission over the internet or method of electronic storage is completely secure, and we cannot guarantee absolute security.
9. Children’s Privacy
The Site is intended for adults and is not directed to children under 13 years of age. We do not knowingly collect personal information from children under 13 through the Site. If you believe a child under 13 has provided us personal information through the Site, please contact us and we will take appropriate steps to delete it.
10. Third-Party Websites
The Site may contain links to websites or services operated by third parties. This Policy does not apply to those websites or services, and we are not responsible for their privacy practices. We encourage you to review the privacy policies of any third-party sites you visit.
11. Your Privacy Rights
Depending on where you live, you may have certain rights regarding your personal information under applicable law, which may include the right to request access to the personal information we hold about you, the right to request correction of inaccurate information, the right to request deletion of your information, and the right to opt out of certain uses or disclosures. These rights are subject to exceptions, including our legal, ethical, and professional obligations to retain certain records.
You may review, update, correct, or request deletion of the personal information you have provided through the Site at any time by emailing us at info@mayberry.law or by using the contact information in Section 14. We may need to verify your identity before responding to a request, and we will respond within the time frames required by applicable law. We will not discriminate against you for exercising your privacy rights.
California residents. Under California Civil Code Section 1798.83 (the “Shine the Light” law), California residents may request information regarding any disclosure of personal information to third parties for those parties’ direct marketing purposes. In addition, to the extent the California Consumer Privacy Act, as amended by the California Privacy Rights Act (CCPA/CPRA), applies to the Firm, California residents have the rights to know, correct, and delete personal information, to opt out of the sale or sharing of personal information, and to limit the use of sensitive personal information, in each case as provided by that law. As stated above, we do not sell personal information.
12. Visitors from Outside the United States
The Site is operated from the United States and is intended for visitors located in the United States. If you access the Site from outside the United States, you understand that your information will be transferred to, stored, and processed in the United States, where privacy laws may differ from those in your jurisdiction.
13. Changes to This Policy
We may update this Policy from time to time. When we do, we will revise the Effective Date at the top of this page and post the updated Policy on the Site. Your continued use of the Site after an update constitutes your acceptance of the revised Policy.
