Los Angeles Workplace Accident Lawyer

A workplace injury may involve workers' compensation, a third-party claim, or both. Mayberry Law helps injured workers preserve reporting, medical, wage, safety, and outside-party evidence while separating the benefit system from any civil claim.

Work Injuries Can Involve Two Different Legal Tracks

Workers' compensation generally addresses medical treatment and wage-related benefits without requiring proof of employer negligence. A separate claim may exist against a non-employer whose conduct or product contributed to the injury.

What to Do After a Workplace Injury

Get emergency care when needed, report the injury promptly, and preserve both the benefit-claim record and any evidence showing that an outside person, contractor, driver, property owner, or product contributed.

Read California DWC injured-worker guidance

Get appropriate medical care

For an emergency, call 911 or go to an emergency room and identify the condition as work-related. Follow the employer's treatment instructions when appropriate and document all affected body parts.

Report the injury promptly

Notify a supervisor as soon as possible. California DWC warns that waiting more than 30 days can jeopardize workers' compensation benefits.

Complete and keep the DWC-1

Complete the employee section, return it promptly, and keep a dated copy. Describe the injury and affected body parts accurately.

Preserve the scene and safety record

When safe, photograph equipment, guards, warnings, conditions, vehicles, and the location. Keep witness, training, schedule, and incident-report information.

Identify outside parties

Record contractors, property owners, drivers, manufacturers, vendors, and other non-employers who controlled equipment or contributed to the event.

Workers' Compensation and Third-Party Claims Cover Different Losses

The benefit claim and any civil claim must be developed and coordinated separately. Workers' compensation generally provides defined benefits, while a qualifying third-party case may address additional civil damages.

Workers' compensation is a benefit system

California DWC explains that benefits are designed to provide medical treatment, partial wage replacement, and return-to-work support. They do not include pain and suffering or punitive damages.

Claims administrators can dispute scope

Work causation, affected body parts, treatment, disability, earnings, reporting, and timing may become issues even though employer negligence is generally not required.

A non-employer may create a separate claim

A contractor, driver, property owner, manufacturer, or other third party may be subject to a civil claim when its conduct or product contributed to the injury.

Benefits, liens, and civil recovery must be coordinated

Workers' compensation payments, employer rights, insurance, settlement allocation, and third-party damages can interact. Coordination protects against avoidable conflicts.

Benefits and Damages Depend on the Legal Track

The available categories differ between workers' compensation and a third-party civil claim. Each requires its own medical, wage, safety, and causation evidence.

Medical treatment

Reasonable and necessary treatment for the work injury may include physician care, hospital services, therapy, diagnostics, medication, equipment, and related travel, subject to the compensation system.

Disability and wage benefits

Temporary or permanent disability and wage-related benefits depend on medical restrictions, earnings, work status, and the governing workers' compensation rules.

Return-to-work support

Modified work, supplemental job-displacement benefits, and return-to-work resources may apply depending on the claim and employer's ability to accommodate restrictions.

Third-party civil damages

When a separate claim exists, supported losses may include pain, suffering, full wage loss, and other civil damages not available through workers' compensation alone.

Frequently Asked Questions

How quickly should I report a work injury?+
California DWC says to notify the employer as soon as possible and warns that failure to report within 30 days could cause a worker to lose the right to benefits. See DWC injured-worker guidance.
Do I have to prove my employer was negligent?+
Workers' compensation generally does not require proof of employer negligence when the statutory conditions are met. Disputes can still arise over work causation, reporting, medical issues, and the scope of benefits.
Can I have workers' compensation and a third-party claim?+
Potentially. Labor Code §3852 preserves an employee's claim against a person other than the employer when that third party caused the injury. The matters must be coordinated. See Labor Code §3852.
What does workers' compensation cover?+
California DWC describes medical treatment, partial wage replacement, and return-to-work support, while noting that workers' compensation does not include pain and suffering or punitive damages. See DWC's overview.
